Introduction

These Terms and Conditions govern the sale and custom creation of leotards and costumes for artistic gymnastics, acrobatics, and other sports through Modlen Store and Modlen Studio. By placing an order, you acknowledge and agree to be bound by these Terms and Conditions.

Measurements

Customers are solely responsible for providing accurate and complete measurements to Modlen Studio for custom-made leotards.

If a leotard produced by Modlen Studio does not fit exclusively due to an error in crafting according to the measurements provided, the customer may return the item within 7 days of delivery for a corrected replacement.

Colours and Design

Due to ongoing variations in fabric availability on the market, fabric colours may slightly differ from one order to another. The same design ordered at different times may therefore present minor colour variations. Modlen Studio makes every reasonable effort to select the closest possible match while preserving the overall design concept and aesthetic integrity.

Authorship, Handmade Nature, and Acceptable Variations

Each leotard created by Modlen Studio is an original author’s design and is entirely handmade as part of a bespoke, non-industrial atelier process. Modlen Studio does not operate as a factory or mass-production facility.

While Modlen Studio aims to replicate the design presented in Modlen Store images as accurately as possible, minor deviations may occur as a natural result of custom, hand-crafted production. Such acceptable variations may occasionally include, but are not limited to:

• slight differences in decorative elements or their placement;

• minor paint traces, dots, lines, or similar markings resulting from hand painting or manual finishing techniques;

• subtle variations inherent to individual, non-automated workmanship.

These characteristics may occasionally occur in handmade production and do not constitute manufacturing defects. Modlen Studio consistently strives to minimize such occurrences and maintains high quality standards throughout all stages of design, tailoring, and final finishing, in accordance with the selected product type and the agreed order budget.

Replicating Past Designs

If you or your team have previously ordered a specific design from Modlen Studio and wish to place a repeat order, please inform us by email in advance so we can reproduce the design as closely as possible.

Please note that even in the case of repeat orders, minor variations may still occur due to the handmade, atelier-based nature of production, while the core concept, structure, and visual identity of the costume shown in Modlen Store photographs will be preserved.

Shipping, Delivery, Customs Duties and Non-Refundable Custom Goods

All international orders are shipped under DAP (Delivered At Place) terms unless otherwise expressly agreed in writing.

Import duties, VAT, customs clearance fees, brokerage charges, and any other taxes or fees imposed by the destination country are the sole responsibility of the recipient. These charges are determined by local authorities and are outside the control of Modlen Studio*. We are unable to predict or guarantee the amount of such fees.

The recipient is responsible for providing any documents, identification numbers, confirmations of payment, or additional information required by customs authorities in the destination country for clearance purposes.

Modlen Studio* is not responsible for customs clearance delays, inspections, temporary holds, or any actions taken by customs authorities that may result in extended delivery times.

If a shipment is refused, unclaimed, abandoned, or returned due to unpaid customs duties, failure to provide required documentation, or any reason not related to a confirmed manufacturing defect, the following conditions apply:

• Original shipping costs are non-refundable.

• Return shipping fees, customs return charges, storage fees, administrative fees, and any related costs will be deducted from any applicable refund.

• If return shipping and related charges exceed the product value, no refund will be issued.

All leotards and costumes produced by Modlen Studio* are custom-made, bespoke products created according to individual measurements and selected design options. Due to their personalized nature, custom-made items are non-refundable and non-exchangeable, except in cases of confirmed manufacturing defects or proven production errors.

Failure to pay customs duties or refusal to accept delivery does not constitute a product defect and does not create eligibility for cancellation or refund.

If a shipment is returned due to unpaid customs duties and the customer requests re-shipment, new shipping charges must be paid in full prior to dispatch.

By placing an order, the customer acknowledges and agrees to these international shipping and custom production terms.

* For the purposes of this section, “Modlen Studio” includes the legal entity operating the brand, its management (including CEO Mr. Oleksandr Levytskyi), employees, contractors, and any third-party shipping carriers or courier services engaged for delivery. None of the foregoing parties determine, control, or are responsible for customs duties, import taxes, or related governmental charges imposed by the destination country.
